SmartGames Playroom is a digital learning environment with educational puzzle games that train problem-solving thinking, logical reasoning, memory, and analytical thinking. You may only use the Service and the Website in accordance with these Terms and for the purposes corresponding to your subscription formula. We may, but are not obliged to, remove content and accounts without prior notice or justification if, in our sole discretion, we determine that they are unlawful, offensive, threatening, pornographic, obscene or otherwise objectionable, or they otherwise breach these Terms.
You may create a hyperlink on your own website to the home page of our Website. If you wish to create a "deep link" to specific content on our Website, you must obtain our express prior written consent. SMART reserves the right to modify or discontinue the Service or any part thereof (including but not limited to the games offered on the Website) temporarily or permanently, with or without notice, at any time.
The User shall indemnify SMART for any breaches committed by the User of these Terms and Conditions or of SMART's rights.
5. Membership and account
Only natural persons may create a membership account. Accounts registered by "bots" or other automated methods are not permitted. SMART reserves the right to refuse the creation of a particular account for reasonably justified reasons, including but not limited to the provision of incorrect or incomplete information, whether or not intentionally.
You must provide at least a username, a valid e-mail address and a password to complete the membership sign-up process and create a membership account.
Children aged 16 or younger must also provide a valid e-mail address of one of their parents to create a membership account. You must keep your account up to date. Any change to your contact details must be notified to SMART immediately. A login may only be used by one person. A login shared by multiple persons is not permitted.
One person may not manage more than one account, except for teachers or parents. You are solely responsible for all activities that occur and/or information that is exchanged under your membership account.
You are solely responsible for maintaining the security of your membership account and password. You shall notify SMART immediately of any unauthorised use of your membership account or any other security breach.
You are solely responsible for correctly logging out of your account at the end of each session, in particular by clicking "Log Out" on the Website. SMART cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation. If login details are deliberately shared by a user, SMART reserves the right to claim damages from that user or from the school or organisation with which he or she is affiliated.
6. Subscription
SMART offers you the possibility to purchase a subscription that grants you full access to the Service for a certain period (hereinafter the "Subscription").
If you create an account on the Website, you are entitled to try the Service free of charge and without obligation for a trial period of 14 days, with no requirement to purchase a Subscription.
If you wish to continue using the Subscription after the aforementioned trial period, you must purchase a paid Subscription. The different subscription formulas and their pricing information can be consulted via https://playroom.smartgames.com/en/pricing. The prices listed on that website include VAT and are charged before each reference period.
The purchase of a Subscription is completed when you receive a confirmation e-mail from SMART.
You may choose from the following payment methods:

Within 14 days after activation of a Subscription, you have the right to inform SMART of your wish to cancel the purchase of that Subscription without giving any reason and without payment of any compensation. You will receive a full refund of the purchased Subscription within 30 days.
From 14 days after activation of a Subscription, the Subscription can only be cancelled in accordance with clause 7 of these Terms.
A Subscription may only be purchased by an adult (18 years or older). SMART is not responsible if minors aged 16 or younger purchase a Subscription without the required approval.
7. Cancellation
You may cancel your Subscription at any time. You may also delete your account at any time via the "Delete my account" button on the "Edit my account" page (https://playroom.smartgames.com/en/profile/edit). You are solely responsible for correctly cancelling your membership account. An e-mail or request by telephone or fax to cancel your account will not be considered a proper cancellation.
You may cancel a Subscription at any time by notifying SMART of your request to cancel the Subscription via the contact details above, without any cost other than any costs associated with transmitting your request.
The cancellation of your Subscription shall take effect on the expiry date of the Subscription. We may, but are not obliged to, cancel any membership account and/or Subscription without prior notice or justification in the event of a serious error by the user. Such error may include, inter alia, any unlawful use of the Service; any incorrect, inaccurate, out-of-date or incomplete provision of information; or any use otherwise contrary to these Terms or that may be considered offensive, threatening, pornographic, obscene or otherwise objectionable. Such cancellation of your membership account and/or Subscription shall have the same consequences as cancellation by you, without prejudice to SMART's right to claim compensation for damages suffered as a result of such fault.
You will be notified of the cancellation of your membership account and/or Subscription by e-mail to the last e-mail address provided by you.
8. Copyright and other intellectual property rights
All content on the Website, including all games (including games available for download as "apps"), as well as texts, drawings, photographs, films, videos, music, images, data, databases, software (including source code), names, trademarks, logos and/or other elements used in those games, is protected by intellectual property rights (including but not limited to copyright, trademark registrations, patents, software protection and database protection) and belongs to SMART and/or its affiliated companies.
All databases of the Website are protected by database law, both in terms of structure and content. SMART, its logos, images, icons, scripts and service names are trademarks or trade dress.
None of SMART's works protected by intellectual property rights, nor SMART's logos, names and (trade)marks, may be used in connection with any product or service that is not SMART's without SMART's permission. All other works, logos, names and (trade)marks that are not owned by SMART and that appear or may appear on the Website are the property of their respective owners, whether or not affiliated with, connected to, or sponsored by SMART.
It is strictly prohibited to store, copy, reproduce, modify, publish, distribute, transmit or sell information and content (including but not limited to the games displayed) that are available on the Website or provided through the Website, without SMART's prior written consent. In any event, it is strictly prohibited to transfer such information or content (or to grant any rights to a third party) in a manner that infringes the rights of SMART or any third party.
9. Limitation of liability
You understand and agree that SMART cannot and will not be liable for any direct, indirect, incidental, special or consequential damages, including but not limited to damages for loss of profit, goodwill, use, data or other intangible losses (even if SMART has been advised of the possibility of such damages) resulting from:
Reasonably acceptable malfunctions, interruptions or errors in the electronic delivery of services or information via the Website;
Viruses, hacking, data loss and loss of login details that may occur on the Website despite SMART's security and precautionary measures;
An error and/or negligence committed by employees and/or subcontractors of SMART, or fraudulent falsification of data by third parties as a result of unauthorised intrusion into the Website;
Statements or conduct of third parties on the Website;
The inability to use the Service;
Unauthorised access to or alteration of your transmissions or data;
Other matters relating to the Service.
10. Amendment of the Terms
SMART may, at its sole discretion, amend and revise these Terms at any time. The amended or revised Terms shall take effect at the time they are published on the Website.
Each registered user will be notified by e-mail of the nature of the change or revision to the Terms. For members who have subscribed after the change or revision has been published on the Website, such changes or revisions shall take effect immediately.
Continued use of the Service after notification of the amended or revised Terms shall be deemed your acceptance of the relevant changes or revisions. If you have obtained a Subscription, it is possible that your Subscription has not yet reached its end date at the time the amended or revised Terms are published on the Website. In that case, you may require that the Terms applicable at the time of activation of your Subscription remain in force until your Subscription reaches its end date.

11. Competitions
If you wish to participate in certain competitions, we will inform you of any specific and/or general rules and/or restrictions applicable to such competitions.
By participating in such competitions, you agree to the rules of that competition, which can be consulted via this Website.
12. Miscellaneous provisions
SMART's failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
SMART may transfer its rights and obligations arising from the agreement to third parties. In that case, SMART will notify you in writing. If one or more aspects of these Terms are, in whole or in part, unenforceable or appear to be unenforceable, this shall not affect the validity and enforceability of the remaining provisions.
In the event of a conflict between these Terms and any special terms for certain services offered via the Service, such special terms shall prevail. In the event of a conflict between these Terms and any mandatory provision of the laws of your country of origin, you shall refrain from any act contrary to the relevant mandatory provisions. You shall indemnify SMART against liability in this respect.
13. Governing law and competent courts
These Terms are governed by Belgian law. The parties agree that, in the event of a dispute relating to the Service (including but not limited to these Terms), only the courts of Antwerp shall have jurisdiction.
